Ariat International is suing Cone Denim for unjust enrichment and recovery of funds wrongfully withheld

Ariat International, Inc., a California-based corporation, has filed a lawsuit against Cone Denim LLC in the United States District Court for the Western District of North Carolina. The case, filed on November 11, 2025, involves Ariat’s attempt to recover $1 million it paid to Cone Denim. This payment was made under pressure from Cone to ensure continued supply of denim fabric essential for Ariat’s business operations. Ariat claims that Cone is unjustly retaining this payment despite assurances that it would be credited towards debts owed by ADN Jeans Group LLC and Rio Sul SA de CV, manufacturers who use Cone’s fabric to produce clothing for Ariat. Complicating matters further, ExpoCredit LLC has initiated separate legal proceedings against Ariat in Florida regarding the same payment. Ariat seeks compensatory damages and other relief from the court.
