In a recent decision by the North Carolina Court of Appeals, the court upheld a trial court’s order for summary ejectment against John and Rita Kotsias, who were appealing the decision. The case involved Graham and Jamie McMurray, who sought to evict the Kotsiases from their property due to breaches of a month-to-month lease agreement. The defendants argued that the trial court erred in its conclusions regarding notice to quit, waiver defenses, and taxation of costs. However, the appellate court found no error in the trial court’s findings or legal interpretations, affirming that proper notice was given and rejecting claims of waiver due to rent acceptance. The costs were also appropriately taxed against the defendants.
