Plaintiff alleges Dental Support Organization violated TCPA with Unwanted Robocalls

A North Carolina company is under fire for allegedly bombarding individuals with unwanted robocalls. On December 5, 2025, Adam Roeder filed a class action complaint in the United States District Court for the Eastern District of North Carolina against Affordable Care, LLC. The lawsuit accuses the company of violating the Telephone Consumer Protection Act (TCPA) by making prerecorded calls to wrong numbers.

According to the complaint, Affordable Care operates a centralized automated calling system that places appointment reminder calls on behalf of over 400 dental practices nationwide. However, the plaintiff alleges that Affordable Care fails to verify whether phone numbers in its database are still assigned to actual patients. This oversight has led to numerous calls being made to individuals who have never been patients and did not consent to receive such communications. Despite notifying Affordable Care or its affiliated practices about these errors and requesting cessation of calls, recipients reportedly continue to receive them.

Roeder’s lawsuit highlights his personal experience with these intrusive calls. He claims that he received multiple prerecorded messages intended for someone named Linda—presumably the previous owner of his phone number—despite never having been a patient at any Affordable Dentures & Implants practice or providing his number to them. These calls, which began on October 18, 2025, persisted even after Roeder explicitly requested removal from their call list.

The plaintiff argues that these actions constitute a breach of the TCPA, which was enacted in 1991 to address growing concerns over telemarketing practices and protect consumers from unsolicited communications. Roeder seeks injunctive relief to halt further violations and demands statutory damages for himself and other affected individuals across the United States who received similar calls without prior express consent.
