Software Company Accuses Beneficiaries of Unauthorized Data Breach

A Kansas-based software company is embroiled in a legal battle over alleged unauthorized access to its computer systems. On December 16, 2025, 1CapApp, LLC filed a verified complaint in the United States District Court for the Western District of North Carolina against Jordan Christian, Jason Christian, Justin Christian, and the Carol Jeanette Christian Revocable Trust. The lawsuit accuses these defendants of unlawfully accessing and misappropriating sensitive business data from 1CapApp’s protected computer systems.

The complaint outlines a series of allegations against the defendants, who are accused of surreptitiously gaining access to an email account and online document storage belonging to 1CapApp. According to the filing, this unauthorized intrusion resulted in the theft of at least 57 gigabytes of sensitive business information and documents. “Defendants took a significant amount of 1CapApp’s sensitive business information,” states the complaint. The company claims that this breach has caused irreparable harm to its relationships with customers and partners, some of which include federal agencies like DHS and ICE.

1CapApp was formed through a merger on March 26, 2021, with key members including Christine Joseph and C. Jeanette Christian holding significant stakes. Following C. Jeanette Christian’s death on July 20, 2025, her children allegedly attempted to assert control over her membership interest via the CJCR Trust without proper authorization or notification as required by the company’s operating agreement. This dispute over membership interest forms part of the broader conflict between the parties.

The plaintiff seeks several forms of relief from the court: compensatory damages for losses incurred due to the breach; injunctive relief to prevent further unauthorized access; declaratory judgment affirming that CJCR Trust is not a member of 1CapApp; punitive damages for what it describes as “intentional, willful, wanton, and malicious conduct” by the defendants; and recovery of attorneys’ fees and costs associated with this litigation.

Representing 1CapApp in this case are attorneys Sean C. Wagner and R. Cuyler Haskins from Wagner Hicks PLLC based in Charlotte, North Carolina. The case has been assigned Case No. 3:25-cv-993 in front of a jury trial as demanded by the plaintiff.
